By Pedro Augusto<\/strong><\/p>\n\n\n\n <\/p>\n\n\n\n The value of arbitration cases administered by the Center for Arbitration<\/em>\u00a0and Mediation of the Chamber of Commerce Brazil-Canada (CAM-CCBC)<\/strong>, Brazil\u2019s largest arbitration institution, increased significantly in 2025. The amounts under dispute totaled R$21.2 billion, compared with R$5.9 billion in the previous year, representing a 259% increase. The average value per case followed the same trend, rising by 265%, from R$56.4 million in 2024 to R$205.6 million in 2025.<\/p>\n\n\n\n The sectoral landscape of the current global economy helps explain the scale of this growth. Half of the new arbitration cases (50.82%) involved shareholder agreements, share purchase and sale transactions, and other corporate disputes, in addition to typical litigation arising from mergers and acquisitions (M&A) operations. These disputes usually involve high reference values, ranging from transaction amounts to indemnity clauses and price adjustment mechanisms, which increases the average value of cases.<\/p>\n\n\n\n Energy (12.3%), real estate (11.48%), banking and financial services (10.66%), and construction and infrastructure (9.84%) complete the economic sectors most represented in arbitration disputes at CAM-CCBC. The data is included in Facts & Figures 2025<\/strong>, the institution\u2019s annual report consolidating the Chamber\u2019s main indicators, which is responsible for approximately 40% of the Brazilian arbitration market.<\/p>\n\n\n\n The increase in the amounts involved in this type of dispute resolution also reinforces a sector trend in which parties seek faster solutions for their conflicts. In sectors such as energy, construction and infrastructure, where contracts extend over years and investments reach billions, arbitration has moved from being an alternative to becoming the natural mechanism for conflict resolution due to its procedural efficiency.<\/p>\n\n\n\n Despite the increase in value and complexity, the average duration of proceedings concluded in 2025 did not increase. On the contrary, it slightly decreased from 26.5 to 24.8 months. Historically, more complex disputes tend to require longer periods for evidence gathering and expert analysis, which would naturally lead to longer proceedings.<\/p>\n\n\n\n Maintaining the timeline at a stable level is therefore an indicator that the Chamber has been able to manage larger-scale cases without compromising predictability in terms of duration, one of the main reasons companies choose arbitration.<\/p>\n\n\n\n \u201cThe growth in the value of disputes reflects the maturity of the Brazilian market: companies of all sizes are turning to arbitration to resolve increasingly complex and higher-value conflicts,\u201d said Rodrigo Garcia da Fonseca, President of CAM-CCBC. \u201cAt the same time, we have managed to reduce the average duration of proceedings, showing that growth and efficiency are not mutually exclusive goals; on the contrary, they advance together when there is continuous investment in structure and governance.\u201d<\/p>\n\n\n\n In 2025, CAM-CCBC administered 504 ongoing arbitration cases \u2014 the largest caseload in its history \u2014 and received 122 new requests throughout the year. In mediation, the Chamber administered 22 cases, with a total value of R$1.1 billion and an average of R$112.6 million per proceeding \u2014 a profile of highly complex disputes in which parties seek a consensual solution before escalating the conflict.<\/p>\n\n\n\n Regarding dispute boards, a mechanism for preventing disputes in infrastructure and concession contracts, the Chamber maintained four active cases in 2025, involving R$2.3 billion. Considering the three mechanisms together, CAM-CCBC handled more than R$24.6 billion in proceedings throughout the year.<\/p>\n\n\n\n The relevance of these figures is further highlighted by CAM-CCBC\u2019s position in the Brazilian market.
