By Marcelo Picolo<\/strong><\/p> The Center for Arbitration and Mediation of the Chamber of Commerce Brazil-Canada (CAM-CCBC) recorded the filing of 148 cases in 2024, including arbitrations, emergency arbitrators, and mediations. This figure represents a 7.3% increase compared to 138 new proceedings in the previous year. The percentage of foreign parties in arbitrations was 14.4% during this period, a significant rise from 5.88% in 2023. These data are part of the Facts & Figures 2024<\/em> report, which provides an overview of the institution\u2019s activities and reflects sector trends in Brazil.<\/p> The statistics highlight the steady and sustainable growth of alternative dispute resolution methods (ADRs) in Brazil, with increasing international market recognition of the quality and legal certainty of Brazilian arbitration practice. CAM-CCBC is the largest center in the sector in the country, accounting for 43.3% of arbitrations administered by the main chambers operating nationwide, according to the Arbitration in Numbers 2024<\/em> survey.<\/p> Considering only arbitrations and emergency arbitrators, the year registered 129 new cases, a rise of approximately 7.5% over 120 cases from the previous period. Of the incoming proceedings, 105 were conventional arbitrations, three emergency arbitrators, and 21 referred to expedited arbitrations.<\/p> Mediations also continued their expansion, with 19 new procedures last year, compared to 16 in the prior period.<\/p> Diversification<\/strong> Expedited arbitrations, for example, have been consolidating as procedures designed to resolve conflicts more simply and quickly. They are suitable for lower-value, less complex cases, enabling faster resolutions since they involve fewer procedural stages and may have only one arbitrator appointed by both parties. CAM-CCBC established this practice through an Administrative Resolution in 2021.<\/p> Adding incoming cases to those already in progress, the Center administered 482 arbitration procedures over the year, 7.6% more than in 2023. In its 45-year history, more than 1,800 cases have passed through CAM-CCBC, including arbitrations, emergency arbitrators, mediations, and dispute boards.<\/p> The average duration of arbitrations closed in 2024 and initiated between 2019 and 2024 was 26.5 months. The average dispute value per case was BRL 56.4 million, while the total amount in dispute during the year reached BRL 5.9 billion. Both the average duration and dispute amounts were influenced during the period by specific characteristics of ongoing cases.<\/p> The sectors most frequently using arbitration include energy (14% of the total); construction and infrastructure (13%); and banking and finance (12%). Among the most contested matters are corporate disputes, representing 47% of cases.<\/p> Internationalization<\/strong> Highlights include participation from countries such as Norway (21.3% of foreign parties), the United States (18%), Italy (15.7%), Spain (13.5%), Canada (9%), and the United Kingdom (6.7%).<\/p> \u201cBrazil is a safe environment for resolving international disputes. Moreover, there is a growing movement to expand the use of arbitration throughout Latin America, and Brazil is a reference point. We not only receive more cases with foreign parties but are also consulted and promote experience exchange regarding best practices with institutions from various countries,\u201d states Fonseca.<\/p> The globalization of Brazilian arbitration practice is also evident in another statistical analysis published in the Facts & Figures<\/em> study.
