(for\u202fCanadian\u202fand other foreign companies)"},"content":{"rendered":"<p>By Pablo Mourente, Lawyer and Head of International Business at David &amp; Athayde Advogados.<\/p>\n<p>It is\u202fquite\u202fa common-sense\u00a0opinion, at least for Brazilians or\u202fpeople who\u202falready know the Brazilian market, that the employment costs in Brazil are very high.\u00a0And\u00a0the reason is not only related to the employment taxes, but also\u00a0explained by\u00a0the various workers\u2019 rights granted by\u00a0the\u00a0Brazilian legislation, such as 30 calendar days of paid vacation leave per every year of contract and the extra month salary per year that all employees\u202fare entitled\u202fto (the so-called 13th\u202fsalary).<\/p>\n<p>This way, it is important to explain to the multinational companies that have employees in Brazil what is a myth and what is true\u202fabout\u202fthis, and to what extent.<\/p>\n<p>First of all, we need to explain that by \u201cemployment costs\u201d we mean every penny the employers pay on top of the payroll that is\u00a0neither\u00a0salary\u00a0nor compensation, that is to say, we are talking about \u201chidden costs\u201d that can increase (by much, in the Brazilian case) the\u202fpersonnel\u202fcosts.<\/p>\n<p>So what are exactly these costs in the Brazilian case?<\/p>\n<p>As we already mentioned,\u00a0such costs\u202fare represented\u202fby both payroll taxes and workers\u2019 rights.<\/p>\n<p>Payroll taxes in Brazil\u202fcomprise:\u202f<b>a)<\/b>\u202fSocial Security Taxes (which finances the pensions plans and other social security benefits);\u202f<b>b)<\/b>\u202fOther social contributions (which fund several social entities that mainly\u202foffer\u202fprofessional education\u00a0at subsidized rates); and\u202f<b>c)<\/b>\u202fAdditional Termination Tax (FGTS\u2019 additional fine).<\/p>\n<p>When it comes to workers\u2019 rights, Brazil has a very extensive labour legislation, which\u00a0was designed to\u00a0grant a high level of protection for the employees, but at the same time\u00a0increases\u00a0the employment costs\u00a0a lot. It undoubtedly produces an impact on the jobs creation, although it\u202fmay not be\u202fthe main reason of the current high unemployment rate.<\/p>\n<p>There are also\u202fextra\u202frights that some categories of employees can have, granted by collective agreements or at some enterprises\u2019 own policies, but at this time we will only refer to the general rights that\u202fare granted\u202fby the legislation to any sort of employee.\u00a0So here they are:\u202f<b>a)<\/b>\u202fPaid Vacation Leave of 30 days per year (which payment\u202fis added\u202fby an extra bonus of 1\/3 of salary, so the employee gets 4\/3 of a month salary for his annual leave);\u202f<b>b)<\/b>\u202fAn extra month salary per year (the \u201c13th\u202fsalary\u201d);\u202f<b>c)<\/b>\u202fFGTS\u202f(A compulsory severance pay fund financed by the employer amounting\u00a0to\u00a08% of the\u00a0monthly\u00a0employee compensation);\u202f<b>d)<\/b>\u202fNotice of termination (minimum\u202fof 30 days);\u202f<b>e)<\/b>\u202fTermination\u202fFGTS\u202fcompensation fine.<\/p>\n<p>In addition to that, there is also the ripple effect caused by the taxation of some of the mentioned workers\u2019 rights (like the social security taxes, which\u00a0are also levied\u00a0on the vacation leave payment and on the 13th\u202fsalary,\u202ffor example).<\/p>\n<p>Therefore, we could summarize the employment costs in Brazil as follows:<\/p>\n<div class=\"infogram-embed\" data-id=\"brazilian-employment-costs-breakdown-1h9j6qq8me3m6gz\" data-type=\"interactive\"><\/div><script>!function(e,t,s,i){var n=\"InfogramEmbeds\",o=e.getElementsByTagName(\"script\"),d=o[0],r=\/^http:\/.test(e.location)?\"http:\":\"https:\";if(\/^\\\/{2}\/.test(i)&&(i=r+i),window[n]&&window[n].initialized)window[n].process&&window[n].process();else if(!e.getElementById(s)){var a=e.createElement(\"script\");a.async=1,a.id=s,a.src=i,d.parentNode.insertBefore(a,d)}}(document,0,\"infogram-async\",\"\/\/e.infogram.com\/js\/dist\/embed-loader-min.js\");<\/script>\n<p>We must say\u00a0that\u00a0many\u00a0items of the chart above do not represent a monthly disbursement, as we are talking about costs in an economic sense. For example, the cost\u202fof\u202fthe annual paid vacation leave and the\u202frespective\u202fbonus are 1.33 times the employee wage, per year, divided by 12 (to find its monthly equivalent). Since in the leave month the employee does not receive salary, but only his leave payment, the\u202fextra\u202fdisbursement actually only amounts\u00a0to\u00a0the\u202fadditional\u202fbonus of 1\/3 of the month salary. On the other hand, since the employee does not work\u202fduring the leave, the cost informed on the chart includes the\u202fexpense\u202fthe employer could have to replace the employee that is on his leave. In addition, the \u201c13th\u202fsalary\u201d does not increase the monthly\u202fdisbursement, since it\u202fis paid\u202fonly once a\u00a0year (actually split\u00a0into\u00a0two payments, one that\u202fis due\u00a0up to November 30th\u202fand\u00a0the\u00a0other up to December 20th).<\/p>\n<p>As we mentioned in the beginning of this text, the employment costs in Brazil are on average the described above. However, depending on the workers field the showed numbers can go up, as well as they can go down when it comes to SME\u2019s of some industries, which\u00a0have\u00a0the\u202fsocial security taxes\u00a0levied\u00a0in a different way.<\/p>\n<p><b>Anyhow, the total of employment costs showed on the last line of the chart is significant:\u202f\u202f<\/b>on average, an employee in Brazil costs an extra 73.33% on top of his compensation.\u00a0That\u2019s\u00a0why many people say in Brazil an employee costs twice of his salary (in fact, in some\u00a0particular fields\u00a0the employment costs may exceed\u00a0100% of the compensation).<\/p>\n<p>It is true that the most part of the costs described above are workers\u2019 pecuniary rights that the employees will receive at some point,\u00a0like\u00a0once a year or at the contract termination, which means it\u00a0might be not considered as an additional cost by some people, but instead considered as part of the compensation itself.\u202f\u202f<b>But even if we consider only the payroll taxes (and their ripple effect), we are talking about an extra cost of 32.08% on top of the compensation, which is probably higher than in any other country.<\/b><\/p>\n<p>Nevertheless,\u00a0the\u00a0Brazilian workforce is far from being\u00a0among\u00a0the most expensive in the world, because in fact, in terms of comparing its cost with the rest of the\u00a0world\u2019s,\u00a0we must look at\u00a0the combination \u201ccompensation + employment costs\u201d. Since the salaries in Brazil are generally low, by comparing the combined cost we can see that a\u00a0\u201cMobile Developer\u201d\u00a0in\u00a0the province of\u00a0Quebec,\u00a0Canada,\u00a0for example, cost to his employer 56% more than in Brazil, on average. For a\u00a0\u201cMarketing Analyst\u201d\u202fposition, this difference is as high as 87%1.\u00a0<b>It\u00a0<\/b><b>is not different<\/b><b>\u202fif we look at the minimum wage in Quebec and in Brazil: the total cost of the minimum wage in Quebec for an employer is 404% higher than in Brazil!<\/b><\/p>\n","protected":false},"excerpt":{"rendered":"<p>By Pablo Mourente, Lawyer and Head of International Business at David &amp; Athayde Advogados.
