custom_margin=\u00bb60px|||\u00bb custom_css_main_element=\u00bbz-index: 98;\u00bb global_colors_info=\u00bb{}\u00bb]<\/p>\n<p>\nEm cumprimento ao disposto no artigo 12.1 do Regulamento do Centro de Arbitragem e Media\u00e7\u00e3o da C\u00e2mara de Com\u00e9rcio Brasil-Canad\u00e1 (\u201cCAM-CCBC\u201d), fica estabelecida a seguinte tabela de taxas administrativas, honor\u00e1rios de \u00e1rbitros e demais despesas dos procedimentos arbitrais (\u201cTabela de Despesas\u201d), em vigor a partir de 1\u00ba de janeiro de 2017.<\/p>\n<p>A taxa de administra\u00e7\u00e3o, honor\u00e1rios dos \u00e1rbitros, honor\u00e1rios de peritos e fundo de despesas e qualquer outra despesa relacionada (\u201cDespesas da Arbitragem\u201d) ser\u00e3o sempre provisionadas por fatura ou\u00a0commercial invoice\u00a0emitida pelo setor financeiro (\u201cSetor Financeiro\u201d) da C\u00e2mara de Com\u00e9rcio Brasil-Canad\u00e1 (\u201cCCBC\u201d), que se encarregar\u00e1 do recebimento, aloca\u00e7\u00e3o e pagamentos.<\/p>\n<p>Para fins desta tabela, nas arbitragens em que haja m\u00faltiplas Requerentes ou Requeridas, os valores devidos ser\u00e3o rateados entre os componentes do mesmo polo (polo requerente ou polo requerido).<\/p>\n<p>Toda e qualquer refer\u00eancia a \u201cRequerente\u201d ou \u201cRequerida\u201d nessa Tabela de Despesas se entender\u00e1 aplicada ao polo requerente ou ao polo requerido, respectivamente, em caso de arbitragem com m\u00faltiplas partes. Respondent: within forty-five (45) days counted from the Notice on the Request for Arbitration.<\/p>\n<p><strong>Provisioning form: <\/strong>The Financial Department will issue an invoice or commercial invoice for payment (see \u2018XI &#8211; Payment Form\u2019).<\/p>\n<p><strong>IV.\u00a0<a name=\"_Toc469605843\"><\/a><a name=\"_Toc469605799\"><\/a><\/strong><strong><u>Value in<\/u><\/strong><strong><u> dispute for purposes of calculation of administrative fees and arbitrators\u2019 fees<\/u><\/strong><\/p>\n<p><a name=\"_Toc469605844\"><\/a><a name=\"_Toc469605800\"><\/a>a.\u00a0\u00a0\u00a0\u00a0 Definition<\/p>\n<p>The value of the dispute shall be the sum of the request(s) of the Party(ies).<\/p>\n<p>The amounts shall not be added in the cases of (i) mere claim of inadmissibility of the other Party&#8217;s request, or (ii) a mirror request, understood as one that is already contained or reflected in the request of the other Party. In this last hypothesis, the highest estimated value of the mirror request will be adopted.<\/p>\n<p>In case of doubt, the Administration of the CAM-CCBC or the Arbitral Tribunal will decide the matter.<\/p>\n<p><a name=\"_Toc469605845\"><\/a><a name=\"_Toc469605801\"><\/a>b.\u00a0\u00a0\u00a0 Segregation<\/p>\n<p>When a counterclaim is made, either Party may request the segregation of the amount in dispute for the purpose of payment of the administrative fee and arbitrators\u2019 fees. Therefore, Claimant and Respondent will be fully responsible for the payment of the amounts related to their respective requests.<\/p>\n<p>Requests for segregation in which administrative fees and arbitrators\u2019 fees owed by the Party requesting segregation are higher than those that would be collected under the general rule (sum of the amounts of the Parties&#8217; requests) will not be processed.<\/p>\n<p><a name=\"_Toc469605846\"><\/a><a name=\"_Toc469605802\"><\/a>c.\u00a0\u00a0\u00a0\u00a0 Reassessment<\/p>\n<p>At any time and based on the documents and claims presented by the Parties, the CAM-CCBC Board of Directors may reassess the value of the dispute. In the event of an increase in the value of the dispute, the Parties shall complement the amounts due as administrative fee and\/or arbitrators&#8217; fees. Likewise, in case of a decrease in the amount, the CCBC will make the refunds due. The reassessment may be requested at the suggestion of the Arbitral Tribunal or independently of it.<\/p>\n<p><u><strong>V.\u00a0<a name=\"_Toc469605847\"><\/a><a name=\"_Toc469605803\"><\/a>Expense fund<\/strong><\/u>\u00a0(art. <a href=\"\/cam-ccbc-centro-arbitragem-mediacao?page_id=8595#a12\" target=\"_blank\" rel=\"noopener noreferrer\">12.6.1<\/a> and\u00a0<a href=\"\/cam-ccbc-centro-arbitragem-mediacao?page_id=8595#a12\" target=\"_blank\" rel=\"noopener noreferrer\">12.8<\/a> the CAM-CCBC Rules)<\/p>\n<p><strong>Value:<\/strong> The Secretariat will request the provisioning of the expense fund that proves adequate to the procedure, and the initial provisioning will be, unless advised otherwise by the Secretariat, in the minimum amount of R$ 10,000.00.<\/p>\n<p>The CAM-CCBC Secretariat will request the provisioning of the Claimant\u2019s expense fund and, if there is an answer as provided in art. 4.3 of the CAM-CCBC Rules, also of the Respondent\u2019s.<\/p>\n<p><strong>Responsible for Provisioning:<\/strong> Claimant and Respondent.<\/p>\n<p><strong>Deadline for provisioning: <\/strong>The Secretariat will request the issuance of invoices for provisioning whenever necessary to defray the expenses of the Arbitration.
