Objetivo<\/strong><\/span><\/p>\n<p>Esta norma tiene como objetivo disciplinar los criterios y los procedimientos adoptados por la Gesti\u00f3n Financiera de ADR (\u00c1rea Financiera del CAM-CCBC) para la realizaci\u00f3n<br \/>de los pagos a Profesionales Indicados, con domicilio fuera de Brasil, que act\u00faan en los procedimientos administrados por el<strong> CAM-CCBC \u2013 Centro de Arbitraje y Mediaci\u00f3n de la C\u00e1mara de Comercio Brasil-Canad\u00e1.<\/strong><\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=\u00bb3.21.1&#8243;]<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>2. Aplicaci\u00f3n<\/strong><\/span><\/p>\n<p>Esta norma se aplica a todos los Profesionales Indicados, con domicilio fuera de Brasil, que act\u00faan en los procedimientos administrados por el <strong>CAM-CCBC. <\/strong><\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=\u00bb3.21.1&#8243;]<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>3. Definiciones y Conceptos<\/strong><\/span><\/p>\n<ul>\n<li><strong>ADR &#8211; Alternative Dispute Resolution:<\/strong> m\u00e9todos alternativos o adecuados de resoluci\u00f3n de conflictos. Son ejemplos de ADRs: Arbitraje, Mediaci\u00f3n, Controversias sobre Registro de Nombre de Dominio y otros m\u00e9todos de soluci\u00f3n de controversia;<\/li>\n<li><strong>Partes:<\/strong> toda persona (f\u00edsica o jur\u00eddica) que posee procedimiento en curso objetivando la resoluci\u00f3n de controversias;<\/li>\n<li><strong>Profesional Indicado:<\/strong> \u00e1rbitros, mediadores, especialistas y peritos, que act\u00faan en los procedimientos administrados en la resoluci\u00f3n de controversias;<\/li>\n<li><strong>Informe de Costos:<\/strong> prestaci\u00f3n de cuentas encaminada a las partes al final del procedimiento con el desglose de las operaciones financieras (entradas\/ingresos<br \/> y salidas\/gastos);<\/li>\n<\/ul>\n<p>[\/et_pb_text][et_pb_text _builder_version=\u00bb3.21.1&#8243;]<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>4. Premisas<\/strong><\/span><\/p>\n<p>Son premisas para el pago de honorarios y reembolsos de gastos presentados por los Profesionales Indicados:<\/p>\n<ul>\n<li>El aprovisionamiento de los montos indicados en la Tabla de Gastos aplicable y realizado por las Partes;<\/li>\n<li>El momento adecuado para el pago, definido en el Reglamento del CAM-CCBC, en la Tabla de Gastos, en las Resoluciones Administrativas aprobadas por la Presidencia del CAM-CCBC, en el Instrumento de Arbitraje, en el Instrumento de Mediaci\u00f3n o, <a href=\"#premissas2\">en el caso de pericia, conforme determinado por el Tribunal Arbitral\u00b9<\/a>;<\/li>\n<li>Los montos tienen como base la conversi\u00f3n de la moneda de la Rep\u00fablica Federativa de Brasil (Real) en la moneda del pa\u00eds de destino del pago;<\/li>\n<li>El recibimiento, por el \u00c1rea Financiera del CAM-CCBC, de las informaciones y documentos necesarios en la forma prevista en esta Norma.<\/li>\n<\/ul>\n<p>[\/et_pb_text][et_pb_text _builder_version=\u00bb3.21.1&#8243;]<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>5. Los importes pagos, abonados, entregados, empleados o remetidos a persona jur\u00eddica domiciliada\u00a0<\/em><em>en el extranjero a t\u00edtulo de royalties de cualquier naturaleza y de remuneraci\u00f3n de servicios t\u00e9cnicos y de\u00a0<\/em><em>asistencia t\u00e9cnica, administrativa y semejantes se sujetan a la incidencia del impuesto sobre la renta en la<\/em><br \/> <em>fuente a la al\u00edcuota del 15% (quince por ciento).<\/em><\/p>\n<p><em>[\u2026]<\/em><\/p>\n<p><em>II \u2013 se considera:<\/em><\/p>\n<p><em>a) servicio t\u00e9cnico a ejecuci\u00f3n de servicio que dependa de conocimientos t\u00e9cnicos especializados o que\u00a0<\/em><em>involucre asistencia administrativa o prestaci\u00f3n de consultor\u00eda, realizado por profesionales independientes\u00a0<\/em><em>o con v\u00ednculo laboral o, aun, resultante de estructuras automatizadas con claro contenido tecnol\u00f3gico;<\/em><\/p>\n<p><em>[\u2026]<\/em><\/p>\n<p><em>\u00a7 3\u00ba los rendimientos mencionados en el caput recibidos por persona jur\u00eddica domiciliada en pa\u00eds o\u00a0<\/em><em>dependencia con tributaci\u00f3n favorecida a que se refiere el <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/LEIS\/L9430.htm\" target=\"_blank\" rel=\"noopener noreferrer\">Art. 24 de la Ley n\u00ba 9.430 de 1996<\/a><\/em><em>, se sujetan\u00a0<\/em><em>a la incidencia del imposto sobre la renta en la fuente a la al\u00edcuota del 25% (veinticinco por ciento).<\/em><\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=\u00bb3.21.1&#8243; border_width_all=\u00bb1px\u00bb custom_margin=\u00bb||\u00bb custom_padding=\u00bb20px|20px|20px|20px\u00bb locked=\u00bboff\u00bb]<\/p>\n<p>El Profesional Indicado deber\u00e1 destacar el porcentaje de la al\u00edcuota de retenci\u00f3n que le es debida:<\/p>\n<p>1- Al\u00edcuota del 15%;<br \/>2- Al\u00edcuota del 25%;<br \/>3- Al\u00edcuota conforme Acuerdo Internacional entre Brasil y el pa\u00eds de destino del pago;<br \/>4- Otra situaci\u00f3n espec\u00edfica. En este caso, el Profesional Indicado deber\u00e1 informar la base legal que fundamenta la retenci\u00f3n diferenciada.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=\u00bb3.21.1&#8243; custom_margin=\u00bb||\u00bb custom_padding=\u00bb|||\u00bb locked=\u00bboff\u00bb]<\/p>\n<p>El porcentaje de la al\u00edcuota de retenci\u00f3n indicada en la nota ser\u00e1 validada por el \u00c1rea Financiera del CAM-CCBC.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=\u00bb3.21.1&#8243; custom_margin=\u00bb||\u00bb custom_padding=\u00bb|||\u00bb locked=\u00bboff\u00bb]<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>5.3.1. Plazo l\u00edmite para presentaci\u00f3n de las notas de honorarios<\/strong><\/span><\/p>\n<p>El Profesional Indicado deber\u00e1 solicitar la retirada de honorarios debidos hasta 10 (diez) d\u00edas h\u00e1biles contados desde el env\u00edo del e-mail por el \u00c1rea Financiera del CAM-CCBC (Anexo 01)<a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/LEIS\/L9430.htm\" target=\"_blank\" rel=\"noopener noreferrer\"><\/a>, motivado por el cierre del procedimiento de ADR.<\/p>\n<p>Son ejemplos de cierre del procedimiento:<\/p>\n<ul>\n<li>Oficio de extinci\u00f3n;<\/li>\n<li>Sentencia arbitral final o decisi\u00f3n del Profesional Indicado;<\/li>\n<li>Respuesta al pedido de aclaraci\u00f3n; o<\/li>\n<li>Instrumento de Cierre de la Mediaci\u00f3n.<\/li>\n<\/ul>\n<p>El eventual retraso en la emisi\u00f3n del Informe de Costos en raz\u00f3n de pendencia en la retirada del saldo de honorarios ser\u00e1 informado a las Partes involucradas, una vez que la demora puede implicar en el aplazamiento de la emisi\u00f3n del Informe de Costos.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=\u00bb3.21.1&#8243; custom_margin=\u00bb||\u00bb custom_padding=\u00bb|||\u00bb locked=\u00bboff\u00bb]<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>5.4. Gastos del procedimiento<\/strong><\/span><\/p>\n<p><strong>Reservas de billete a\u00e9reo y hospedaje:<\/strong><br \/>El Profesional Indicado deber\u00e1 contactar la Secretar\u00eda del CAM-CCBC, representada por el\/la case manager responsable por la administraci\u00f3n del procedimiento de ADR, y solicitar las reservas. Billete a\u00e9reo y hospedaje ser\u00e1n contratados y pagados directamente por la CCBC en el Brasil;<br \/><strong><\/strong><\/p>\n<p><strong>Otros gastos relacionadas al procedimiento:<\/strong><br \/>El Profesional Indicado podr\u00e1 solicitar el reembolso de los gastos (excepto billete a\u00e9reo y hospedaje) incurridos en la conducci\u00f3n de las actividades a \u00e9l atribuidas, conforme orientaci\u00f3n en el t\u00f3pico 5.5.<\/p>\n<p>Los gastos por bebidas alcoh\u00f3licas no ser\u00e1n reembolsados.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=\u00bb3.21.1&#8243; custom_margin=\u00bb||\u00bb custom_padding=\u00bb|||\u00bb locked=\u00bboff\u00bb]<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>5.5. Plazo l\u00edmite para presentaci\u00f3n de pedidos de reembolso de gastos <\/strong><\/span><\/p>\n<p>El saldo del fundo de gastos del procedimiento de ADR es actualizado diariamente, con el registro de d\u00e9bitos y cr\u00e9ditos.<\/p>\n<p>Para garantizar que haya saldo suficiente para el reembolso, el pedido deber\u00e1 ser recibido por el \u00c1rea Financiera del CAM-CCBC en el plazo de hasta <strong>10 (diez) d\u00edas h\u00e1biles tras la realizaci\u00f3n del gasto.<\/strong><\/p>\n<p>Respecto de los gastos incurridos al final del procedimiento, el \u00c1rea Financiera del CAM-CCBC encaminar\u00e1 e-mail (Anexo 01) notificando el cierre del procedimiento. Se deber\u00e1 recibir la solicitud de eventual reembolso en hasta <strong>10 (diez) d\u00edas h\u00e1biles tras el env\u00edo del e-mail de notificaci\u00f3n del cierre.<\/strong><\/p>\n<p>No se reembolsar\u00e1n los gastos solicitados tras la emisi\u00f3n del Informe Final de Costos encaminado a las Partes.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=\u00bb3.21.1&#8243;]<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>5.6.
