The President of the CAM-CCBC (\u201cCenter for Arbitration and Mediation of the Chamber of Commerce Brazil-Canada\u201d), exercisingits powers under Article 2.6(c) of the CAM-CCBC Arbitration Rules, approved on September 1st, 2011, with the amendments approved on April 28th 2016, with the purpose of giving greater predictability and transparency to the amounts due as arbitrators\u2019 fees, resolves, complementing the Administrative Resolution No. 16\/2016, to establish the parameters that will be adopted for the payment of the fees to the arbitrators in cases of their replacement during the arbitral proceeding, as follows.<\/p>\n

In these cases, the CAM-CCBC will adopt the parameters described in the table below:<\/p>\n

  1. Dismissal in case of challenge of the arbitrator<\/li>\n<\/ol>\n

    In cases of dismissal of the arbitrator determined by the Special Committee constituted under art. 5.4 of the Rules, the members of the List of Arbitrators established to judgethe challenge shall submit a proposal on the amount of fees due and, if applicable, any possible return of anticipated amounts to the parties.<\/p>\n

    1. Recomposition of fees in cases of replacement of arbitrators<\/li>\n<\/ol>\n

      In cases thatit is necessary the replacement ofarbitrators, the CAM-CCBC Secretariat shall forward to the parties the invoices for the provisioning of the supplementation of the arbitrator\u2019s fees, observing the amounts paid to the replaced arbitrator.<\/p>\n

      1. Appointment of arbitrator with partial fees<\/li>\n<\/ol>\n

        Upon a request submitted by the parties in a justified manner, and authorization from the CAM-CCBC Board, the Secretariat may consult the substitute arbitrator on the possibility to act in the procedure receiving only the remaining provisioned fees.<\/p>\n

          \n
        1. Removal due to supervening event attributable to the arbitrator<\/li>\n<\/ol>\n

          If the removal or withdrawal is due to a supervening event attributable to the arbitrator, the CAM-CCBC Board will decide on the final value of the respective fees and, if applicable, will determine the possible return of advance amounts.<\/p>\n

            \n
          1. Inquiry to arbitrators<\/li>\n<\/ol>\n

            In all cases mentioned above, the arbitrators will be consulted and may present their considerations to the CAM-CCBC in order to adapt the proportions described in this resolution. The CAM-CCBC Board will analyze the arbitrators\u2019 deliberations, considering the complexity of the case, decisions rendered in the development of the arbitration, report of hours worked, among others, being able to change the percentage set forth in the table above.<\/p>\n

            Cases not covered herein will be deliberated by the CAM-CCBC Board.<\/p>\n

            Pagamento dos honor\u00e1rios dos \u00e1rbitros<\/strong><\/p>

            O Presidente do CAM-CCBC (\u201cCentro de Arbitragem e Media\u00e7\u00e3o da C\u00e2mara de Com\u00e9rcio Brasil-Canad\u00e1<\/em>\u201d), no uso das atribui\u00e7\u00f5es que lhe s\u00e3o conferidas pelo artigo 2.6., al\u00ednea \u2018c\u2019, do Regulamento do CAM-CCBC, aprovado em 1 de setembro de 2011, resolve que o pagamento dos honor\u00e1rios aos \u00e1rbitros ser\u00e1 realizado conforme descrito abaixo.<\/p>

            \u00a0<\/p>

            1. Valor da causa at\u00e9 R$7.500.000,00<\/strong><\/p>

            O pagamento dos honor\u00e1rios aos \u00e1rbitros que atuam em procedimentos nos quais a remunera\u00e7\u00e3o \u00e9 realizada com base nas horas trabalhadas n\u00e3o sofrer\u00e1 altera\u00e7\u00e3o, ou seja, os \u00e1rbitros poder\u00e3o, ao final do procedimento, solicitar o pagamento das 100 (cem) horas m\u00ednimas, independente de comprova\u00e7\u00e3o de horas trabalhadas ou, alternativamente, no curso do procedimento mediante apresenta\u00e7\u00e3o de relat\u00f3rio de horas.<\/p>

            Os honor\u00e1rios excedentes somente poder\u00e3o ser solicitados ap\u00f3s apresenta\u00e7\u00e3o de relat\u00f3rio comprovando o uso integral das 100 (cem) horas m\u00ednimas. Al\u00e9m disso, a solicita\u00e7\u00e3o dos referidos honor\u00e1rios adicionais dever\u00e1 ser precedida de pedido de provisionamento de horas, direcionada ao setor financeiro e \u00e0 Secretaria.<\/p>

            Para viabilizar a obten\u00e7\u00e3o dos fundos necess\u00e1rios, solicitamos aos senhores \u00e1rbitros que encaminhem a referida estimativa de horas adicionais at\u00e9 30 (trinta) dias antes da apresenta\u00e7\u00e3o da senten\u00e7a arbitral.<\/p>

            Os pagamentos das horas excedentes ser\u00e3o realizados ap\u00f3s o dep\u00f3sito dos valores correspondentes pelas Partes, mediante a apresenta\u00e7\u00e3o de relat\u00f3rio de horas excedentes e nota de honor\u00e1rios.<\/p>

            2. Valor da causa acima de R$7.500.000,00<\/strong><\/p>

            Os honor\u00e1rios dos \u00e1rbitros fixados em parcela \u00fanica proporcional ao valor da causa ser\u00e3o pagos integralmente ap\u00f3s a apresenta\u00e7\u00e3o da senten\u00e7a arbitral.<\/p>

            Os \u00e1rbitros poder\u00e3o retirar antecipadamente at\u00e9 50% do montante, conforme descrito abaixo:<\/p>
