The President of the CAM-CCBC (“Center for Arbitration and Mediation of the Chamber of Commerce Brazil-Canada”), exercising its powers under Article 2.6(c) of the CAM-CCBC Rules, approved on 1 September 2011, with amendments approved on 28 April 2016, after hearing the Advisory Council, hereby decides to disclose the following recommendation regarding the existence of third-party funding in arbitrations administered by the CAM-CCBC.<\/p>\n
The purpose of this recommendation is to inform and guide the parties and the arbitrators on how to address the existence of third-party funding in arbitration proceedings administered by the CAM-CCBC, as well as to clarify the procedure to be adopted by the CAM-CCBC in these cases.<\/p>\n
<\/p>\n
Third-Party Funding<\/u><\/strong><\/p>\n Article 1 –<\/strong> It is considered third-party funding when a natural or legal person who is not party to the arbitration proceedings provides full or partial resources to one party so as to enable or assist the payment of the arbitration costs, receiving in return a portion or percentage of any profits earned from the award or from the agreement.<\/p>\n Article 2 –<\/strong> “Arbitration costs” are considered any amount spent with the proceedings, encompassing, but not limited to, administrative costs, arbitrators’ fees, experts’ fees, attorneys\u2019 fees, costs and defeat fees and conviction values.<\/p>\n <\/p>\n Conflicts of interest with the third-party funder<\/u><\/strong><\/p>\n Article 3 –<\/strong> The presence of a third-party funder can raise reasonable doubt as to the impartiality or independence of the arbitrators, due to possible past or current relationship between the arbitrator and the third-party funder.<\/p>\n Communication<\/u><\/strong><\/p>\n Article 4 –<\/strong> In order to avoid potential conflicts of interest, CAM-CCBC recommends the parties to report the existence of third-party funding to CAM-CCBC at the earliest opportunity. The complete qualification of the funder should be included in this communication.<\/p>\n Article 5 –<\/strong> When this communication is received, CAM-CCBC shall inform the arbitrators and invite them to perform a conflict check and to reveal any information that may raise justifiable doubt as to their independence and impartiality. Valor da causa at\u00e9 R$7.500.000,00<\/strong><\/p> O pagamento dos honor\u00e1rios aos \u00e1rbitros que atuam em procedimentos nos quais a remunera\u00e7\u00e3o \u00e9 realizada com base nas horas trabalhadas n\u00e3o sofrer\u00e1 altera\u00e7\u00e3o, ou seja, os \u00e1rbitros poder\u00e3o, ao final do procedimento, solicitar o pagamento das 100 (cem) horas m\u00ednimas, independente de comprova\u00e7\u00e3o de horas trabalhadas ou, alternativamente, no curso do procedimento mediante apresenta\u00e7\u00e3o de relat\u00f3rio de horas.<\/p> Os honor\u00e1rios excedentes somente poder\u00e3o ser solicitados ap\u00f3s apresenta\u00e7\u00e3o de relat\u00f3rio comprovando o uso integral das 100 (cem) horas m\u00ednimas. Al\u00e9m disso, a solicita\u00e7\u00e3o dos referidos honor\u00e1rios adicionais dever\u00e1 ser precedida de pedido de provisionamento de horas, direcionada ao setor financeiro e \u00e0 Secretaria.<\/p> Para viabilizar a obten\u00e7\u00e3o dos fundos necess\u00e1rios, solicitamos aos senhores \u00e1rbitros que encaminhem a referida estimativa de horas adicionais at\u00e9 30 (trinta) dias antes da apresenta\u00e7\u00e3o da senten\u00e7a arbitral.<\/p> Os pagamentos das horas excedentes ser\u00e3o realizados ap\u00f3s o dep\u00f3sito dos valores correspondentes pelas Partes, mediante a apresenta\u00e7\u00e3o de relat\u00f3rio de horas excedentes e nota de honor\u00e1rios.<\/p> \u00a0<\/p> 2.
