header_font_size=&#8221;20px&#8221; z_index_tablet=&#8221;500&#8243;]<\/p>\n<h1>Payment rules for professionals outside Brazil<\/h1>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;3.21.1&#8243;]<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>1.\u00a0Objective<\/strong><\/span><\/p>\n<p>This standard aims to provide for the rules on the criteria and procedures adopted by the ADR Financial Management (CAM-CCBC Financial Area) to make payments to Appointed Professionals domiciled outside Brazil and who act in the proceedings<br \/>administered by the <strong>CAM-CCBC \u2013 Center for Arbitration and Mediation of the Chamber of Commerce Brazil-Canada.<\/strong><\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;3.21.1&#8243;]<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>2.\u00a0Application<\/strong><\/span><\/p>\n<p>This rule applies to all Appointed Professionals domiciled outside Brazil who act in the proceedings administered by the <strong>CAM-CCBC.<\/strong><\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;3.21.1&#8243;][\/et_pb_text][et_pb_text _builder_version=&#8221;3.21.1&#8243;]<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>3.\u00a0Definitions and concepts<\/strong><\/span><\/p>\n<p><span style=\"text-decoration: underline;\"><strong><\/strong><\/span><\/p>\n<ul>\n<li><strong>ADR &#8211; Alternative Dispute Resolution:<\/strong> alternative or appropriate methods of\u00a0dispute resolution. Examples of ADRs include: Arbitration, Mediation, Controversies over Domain Name Registration, and other methods of dispute resolution;<\/li>\n<li><strong>Parties:<\/strong> any person (individual or legal entity) who is a party to an ongoing proceeding for the resolution of controversies;<\/li>\n<li><strong>Appointed Professional:<\/strong> arbitrators, mediators, specialists and experts, whoact in the proceedings administered in the resolution of disputes;<\/li>\n<li><strong>Costs Report:<\/strong> rendering of accounts sent to the parties at the end of the proceedings detailing the financial operations (receipts \/ revenues and expenses);<\/li>\n<\/ul>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;3.21.1&#8243;]<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>4.\u00a0Premises<\/strong><\/span><\/p>\n<p>The following are premises for the payment of fees and reimbursements of expenses presented by the Appointed Professionals:<\/p>\n<ul>\n<li><span style=\"font-size: 14px;\">Provisioning of the amounts indicated in the applicable Table of Expenses, and paid by the Parties;<\/span><\/li>\n<li>The appropriate time for payment, defined in the CAM-CCBC Rules, the Table of Expenses, the Administrative Resolutions approved by the CAM-CCBC President,<br \/> the Arbitration Terms of Reference, the Mediation Terms of Reference or, in case of expert examination, as determined by the Arbitral Tribunal\u00b9;<\/li>\n<\/ul>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;3.21.1&#8243;]<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>5. Any amounts paid, credited, delivered, employed or remitted to a legal entity domiciled abroad as\u00a0<\/em><em>royalties of any kind and remuneration for technical services and technical, administrative and similar\u00a0<\/em><em>assistance must observe the income tax withheld at source at the rate of fifteen percent (15%).<\/em><\/p>\n<p style=\"text-align: justify;\"><em>[\u2026]<\/em><\/p>\n<p style=\"text-align: justify;\"><em>II \u2013 one states that:<\/em><br \/> <em> a) a technical service is the performance of a service that depends on specialized technical knowledge or<\/em><br \/> <em> that involves administrative assistance or consultancy, carried out by independent professionals or with an<\/em><br \/> <em> employment relationship or, also, due to automated structures with clear technological content;<\/em><br \/> <em> <\/em><\/p>\n<p style=\"text-align: justify;\"><em>[\u2026]<\/em><\/p>\n<p style=\"text-align: justify;\"><em>\u00a7 3\u00ba The income mentioned in the main clause herein, and received by a legal entity domiciled in a country<\/em><br \/> <em> or jurisdiction enjoying favored taxation referred to in <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/LEIS\/L9430.htm\" target=\"_blank\" rel=\"noopener noreferrer\">Art. 24 of Law No. 9430 of 1996<\/a>, is subject to income<\/em><br \/> <em> tax at the rate of twenty-five percent (25%).<\/em><\/p>\n<p style=\"text-align: justify;\"><em><\/em><\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;3.21.1&#8243; border_width_all=&#8221;1px&#8221; custom_margin=&#8221;||&#8221; custom_padding=&#8221;20px|20px|20px|20px&#8221; locked=&#8221;off&#8221;]<\/p>\n<p>The Appointed Professional shall highlight the percentage of the withholding tax rate owed by him:<\/p>\n<p>1. 15% Tax Rate;<br \/>2. 25% Tax Rate;<br \/>3. Tax Rate applicable under an International Agreement between Brazil and the country of remittance where payment is to be made;<br \/>4. Another specific situation. In this case, the Appointed Professional shall inform the legal grounds of any distinct withholding.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;3.21.1&#8243; custom_margin=&#8221;||&#8221; custom_padding=&#8221;|||&#8221; locked=&#8221;off&#8221;]<\/p>\n<p style=\"text-align: justify;\">The withholding rate percentage mentioned in the Note shall be validated by CAM-CCBC Financial Area.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;3.21.1&#8243; custom_margin=&#8221;||&#8221; custom_padding=&#8221;|||&#8221; locked=&#8221;off&#8221;]<br \/>\n[\/et_pb_text][et_pb_text _builder_version=&#8221;3.21.1&#8243; custom_margin=&#8221;||&#8221; custom_padding=&#8221;|||&#8221; locked=&#8221;off&#8221;]<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>5.3.1. Time-Limit for submission of fee notes<\/strong><\/span><\/p>\n<p>The Appointed Professional shall request the withdrawal of fees up to ten (10) business days from the e-mail sent by the CAM-CCBC Financial Area (Exhibit 01), after the closing of the ADR proceedings.<\/p>\n<p>Examples of closing of proceedings:<\/p>\n<ul>\n<li><span style=\"font-size: 14px;\">Termination Order;<\/span><\/li>\n<li>Final arbitral award or decision rendered by the Appointed Professional;<\/li>\n<li>Answer to the request for clarifications; or<\/li>\n<li>Closing Agreement.<\/li>\n<\/ul>\n<p>Any delay in the issuance of the Cost Report resulting from the pending withdrawal of the balance of fees, will be informed to the Parties involved, since the delay may imply the postponement of the Cost Report issuance.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;3.21.1&#8243; custom_margin=&#8221;||&#8221; custom_padding=&#8221;|||&#8221; locked=&#8221;off&#8221;]<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>5.4. Proceedings Expenses<\/strong><\/span><\/p>\n<ul>\n<li><strong>Air ticket and accommodation:<\/strong><br \/>The Appointed Professional shall contact the Secretariat of the CAM-CCBC (represented by the case manager responsible for administering the ADR proceedings) and request the reservations. The cost of air ticket andaccommodation shall be contracted and paid directly by CCBC in Brazil;<\/li>\n<li><strong>Other proceedings-related expenses:<\/strong><br \/>The Appointed Professional may request the reimbursement of expenses (except air ticket and accommodation) incurred by him\/her, when performing the activities assigned, as per topic 5.5 of this Standard.<\/li>\n<\/ul>\n<p>Expenses with alcoholic beverages will not be reimbursed.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;3.21.1&#8243; custom_margin=&#8221;||&#8221; custom_padding=&#8221;|||&#8221; locked=&#8221;off&#8221;]<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>5.5. Time-limit for submission of requests for the reimbursement of expense<\/strong><\/span><\/p>\n<p>The balance of the ADR proceedings\u2019 expenses fund is updated daily, upon registration of debits and credits.<br \/>To ensure that the proceedings will have enough balance for the reimbursement, the request must be received by the CAM-CCBC Financial Area within <strong>ten (10) business<\/strong><br \/><strong>days<\/strong> after the expenses are incurred.<\/p>\n<p>As for the costs incurred at the end of the proceedings, the CAM-CCBC Financial Area will forward e-mail (Exhibit 01) notifying the termination of the proceedings.
