The President of the Center for Arbitration and Mediation of the Chamber of Commerce Brazil-Canada (\u201cCAM-CCBC\u201d), in the exercise of the duties assigned to him byby Article 2.6, letter \u2018c\u2019, of the CAM-CCBC Rules (\u201cRules\u201d), as approved on September 1, 2011, in compliance with (i) article 5.1 of the Rules, which provides for the independence, impartiality and availability of the arbitrators; (ii) Statement 2 \u2013 Diligence, Competence and Availability, of the CAM-CCBC Code of Ethics; and (iii) in order to provide greater transparency to arbitration proceedings, decides to establish rules for the publication of information related to the participation of arbitrators in CAM-CCBC arbitration proceedings.<\/p>\n
Article 1<\/strong> \u2013 In arbitrations under its administration, CAM-CCBC will publish, on its website, the following information about the Arbitral Tribunals:<\/p>\n I.<\/strong> Arbitrator\u2019s full name;<\/p>\n II.<\/strong> Arbitrator\u2019s nationality;<\/p>\n III.<\/strong> Month and year of signature of the Terms of Reference;<\/p>\n IV.<\/strong> Position in the Arbitral Tribunal (President\/Coarbitrator\/Sole Arbitrator);<\/p>\n V.<\/strong> Arbitrator appointed by (Parties\/Coarbitrator\/CAM-CCBC); and<\/p>\n VI.<\/strong> Status of the proceeding (Ongoing\/Suspended\/Closed).<\/p>\n Sole paragraph \u2013 The information will not be published in the event of manifestation to the contrary by any of the parties.<\/p>\n Article 2<\/strong> \u2013 In compliance with the duty of confidentiality, information related to the arbitration will not be published, including, but not limited to, the number of the arbitration proceeding, the names of the parties and their lawyers.<\/p>\n Article 3<\/strong> \u2013 In cases in which the arbitrator is substituted, either due to resignation, death, incapacity or removal due to challenge or due to a supervening fact attributable to the arbitrator, CAM-CCBC will update the information published on the website.<\/p>\n Article 4<\/strong> \u2013 By accepting to act as an arbitrator under the terms of the Rules, the arbitrator agrees with the publication of the information listed in article 1 of this resolution on the CAM-CCBC website.<\/p>\n Article 5<\/strong> \u2013 The information will be updated periodically by the CAM-CCBC Secretariat.<\/p>\n Article 6<\/strong> \u2013 This resolution applies to all Requests for Arbitration filed as of January 7, 2019.<\/p>\n Sole paragraph \u2013 Valor da causa at\u00e9 R$7.500.000,00<\/strong><\/p> O pagamento dos honor\u00e1rios aos \u00e1rbitros que atuam em procedimentos nos quais a remunera\u00e7\u00e3o \u00e9 realizada com base nas horas trabalhadas n\u00e3o sofrer\u00e1 altera\u00e7\u00e3o, ou seja, os \u00e1rbitros poder\u00e3o, ao final do procedimento, solicitar o pagamento das 100 (cem) horas m\u00ednimas, independente de comprova\u00e7\u00e3o de horas trabalhadas ou, alternativamente, no curso do procedimento mediante apresenta\u00e7\u00e3o de relat\u00f3rio de horas.<\/p> Os honor\u00e1rios excedentes somente poder\u00e3o ser solicitados ap\u00f3s apresenta\u00e7\u00e3o de relat\u00f3rio comprovando o uso integral das 100 (cem) horas m\u00ednimas. Al\u00e9m disso, a solicita\u00e7\u00e3o dos referidos honor\u00e1rios adicionais dever\u00e1 ser precedida de pedido de provisionamento de horas, direcionada ao setor financeiro e \u00e0 Secretaria.<\/p> Para viabilizar a obten\u00e7\u00e3o dos fundos necess\u00e1rios, solicitamos aos senhores \u00e1rbitros que encaminhem a referida estimativa de horas adicionais at\u00e9 30 (trinta) dias antes da apresenta\u00e7\u00e3o da senten\u00e7a arbitral.<\/p> Os pagamentos das horas excedentes ser\u00e3o realizados ap\u00f3s o dep\u00f3sito dos valores correspondentes pelas Partes, mediante a apresenta\u00e7\u00e3o de relat\u00f3rio de horas excedentes e nota de honor\u00e1rios.<\/p> \u00a0<\/p> 2.
